A gravely injured Dallas duo is seeking more than $1 million from a bod shop that did shoddy work on their Honda, according to a lawsuit.
Matthew Seebachan, 33, and his wifey Marcia were almost killed on Dec. 21, 2013, when their two thousand ten Honda Fit was struck by another car on US two hundred eighty one in Burnet County, according to court documents filed in Dallas County District Court.
When the duo had purchased the car, the CarFax report did not reflect work done on its roof by the John Eagle Collision Center.
The roof of the car was repaired with glue instead of being welded, said figure shop director John Boyce in a deposition. The car’s previous holder had taken it to John Eagle in July two thousand twelve to get its roof repaired following a hail storm.
Because the shop did not repair the car decently, the fuel tank and structural integrity of the car was compromised in the accident, according court documents.
“It is effectively disconnected from the structure and did not provide the necessary contribution to the overall vehicle structure. There are no welds at the flange inbetween the roof and the cant rail,” stated the court documents. “After the accident, the vehicle caught on fire, and Matthew Seebachan sustained serious burn injuries. He was trapped in the searing vehicle, and was conscious while his figure burned.”
A request for comment was placed with Boyce and the lawyer signifying the Seebachan’s.
